1. Introduction

Welcome to Aggarly (“we,” “us,” “our,” or “the Company”), your comprehensive aggregator platform for short-term rentals. These Terms & Conditions (“Terms”) govern your access to and use of our services (“Services”), including our website, mobile application, and any other related offerings. By using Aggarly, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Governing Law & UAE Jurisdiction

Aggarly is established under the laws of the United Arab Emirates (“UAE”), and these Terms shall be governed in all respects by UAE law without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be exclusively subject to the jurisdiction of the competent courts in the UAE.

4. Eligibility & Acceptance

You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding contracts. By accessing Aggarly, you confirm your acceptance of these Terms. Should you disagree with any provision, you must discontinue use of our Services immediately.

5. Account Registration & Security

Accuracy of Information: You agree to provide true, accurate, and current data during registration.
Credential Safety: You are responsible for protecting your login information and any activities under your account. Notify Aggarly immediately of any unauthorized access or suspicious activity.
Host & Provider Obligations: If you are listing a property or service, you must comply with all UAE local regulations and ensure that your listings adhere to municipal or community guidelines.

6. Fees, Commissions & Payment

6.1 Aggarly Fee: We deduct a standard 5% Aggarly fee plus a 15% channel commission from each confirmed booking. All fees are withheld at the point of payout to you.

6.2 Cancellation & Refunds: Should a guest cancel under circumstances where they do not receive a full refund, the applicable fees will remain due. Refer to our Refund Policy for additional details.

6.3 Payment Processing: Aggarly may partner with third-party payment providers to handle transactions. By using our platform, you agree to their terms and authorize us to process funds on your behalf.

7. User Conduct & Prohibited Activities

You agree not to engage in any activity that:

Violates any local UAE or international law.
Infringes on the rights of others or Aggarly’s intellectual property.
Is fraudulent, deceptive, obscene, or otherwise harmful.
Interferes with Aggarly’s systems, networks, or security measures.

8. Intellectual Property & Copyright

All content and materials on Aggarly, including text, graphics, logos, icons, images, code, and software, are the exclusive property of Aggarly or its licensors, protected under UAE and international copyright law. Unauthorized reproduction, distribution, or modification is strictly prohibited.

9. Limitation of Liability

To the maximum extent permitted by UAE law, Aggarly and its affiliates shall not be liable for any indirect, special, or consequential damages—including loss of profits—arising out of or in relation to your use of our Services. Our total liability, if any, shall not exceed the total fees paid by you to Aggarly in the previous three months.

10. Indemnification

You agree to defend, indemnify, and hold harmless Aggarly, its directors, officers, employees, agents, and affiliates from any claims or liabilities arising from your misuse of the Services or breach of these Terms, including any violation of UAE law or third-party rights.

11. Suspension & Termination

We reserve the right to suspend or terminate your account immediately if we suspect any breach of these Terms or any misconduct. Upon termination, any outstanding fees remain due and payable, and Aggarly shall not be liable for any claims resulting from suspension or termination of your access.

12. Changes to These Terms

Aggarly reserves the right to modify or update these Terms at any time. Material changes will be communicated via our website or email. Continued use of our Services following such updates constitutes your acceptance of the new Terms.

13. Refunds & Cancellations

Any refund or cancellation request is subject to Aggarly’s Refund Policy. If a booking is cancelled under conditions where a partial or no refund is provided to the guest, any associated Aggarly and channel fees remain payable.

14. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of these Terms, the parties shall first attempt to settle amicably through negotiation. Failing such resolution, disputes shall be referred exclusively to the UAE courts.
